AGREEMENT BETWEEN YOU AND 10TH PLANET LTD

When shopping with 10th Planet the following Terms & Conditions constitute a legal agreement between you and 10th Planet Limited.

You must accept without modification all of the terms, conditions, and notices contained in these Terms & Conditions in order to access and use the online shopping service.

If you do not accept these Terms & Conditions in their entirety, you may not access or use the services provided by 10th Planet Ltd, doctorwhoshop.co.uk Ltd or www.10thplanetshop.com.

Please read or print a copy of these Terms & Conditions if you intend on shopping with us.

We reserve the right to change this agreement at any time without notice.

1. MODIFICATION OF THESE TERMS OF USE

1.1 10th Planet may wish to update or change the terms, conditions and notices for the service provided from time to time to reflect changes in the service, changes in the laws affecting the Services.

2. REFUNDS AND RETURNS

2.1 At 10th Planet we want you to be happy with every purchase you make through our website store. Occasionally though, we know you may want to return an item, please find below our returns policy. This returns policy does not affect your statutory rights.
2.2 Our "no quibbles" guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition, within 14 days. We accept the return of these items only if they are unopened and in their original condition.
2.3 If you return goods, as detailed above, within 14 days, we will issue a full refund for the price you paid for the item but not the postage costs.
2.4 If your item is faulty/damaged we will accept the return and also cover your postage costs but we must be notified within 48 hours of delivery of the fault/damage.

3. POSTAGE COSTS REFUNDED

3.1 If the item is faulty we will cover your return postage.
3.2 If you are retuning the item because you have changed your mind, any postage incurred is at the customer’s expense.
3.3 We recommend that you send the items back to us via a recorded delivery such as Special or Signed for as we can not be held responsible for any returned items that go missing through Royal Mail or any other service.

4. DATA PROTECTION & PRIVACY STATEMENT

4.1 Each party shall for the duration of any Agreement governed by these Terms and Conditions comply with the provisions of the Data Protection Act 1998, (including the data protection principles set out in that Act) and any similar or analogous laws, regulatory requirements or codes of practice governing the use, storage or transmission of personal data and shall not permit anything to be done which might cause or otherwise result in a breach by either party of the same.
4.2. At 10th Planet we are committed to protecting your privacy. We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent.
4.3 We will give you the chance to refuse any marketing email from 10th Planet.
4.4 The type of information we will collect about you includes: * your name * address * phone number * email address * credit/debit card details. This allows us to process and fulfil your orders and to notify you of the status of your order.
4.5 When you place orders with us on the internet we offer the use of a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. Our security procedures mean that we may request proof of identity before we are able to disclose sensitive information to you.
4.6 The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law and the Which? Web Trader Code. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
4.7 We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. 5. PAYMENT POLICY

5.1 10th Planet reserves the right to change prices or services at any time.
5.2 Payment by Credit or Debit Card will be processed by us and will appear on your Credit/Debit Card statement as 10th Planet Ltd.
5.3 Payment via Cheque, please write your bank cheque guarantee card details on the reverse of the cheque before sending payment as this will delay your order while we contact you for the necessary information. If a cheque you send us is refused by your bank a £10 administration charge will be incurred.
5.4 PayPal is an authorised payment processor for 10th Planet Limited.
5.5 Google Checkout is an authorised payment processor for 10th Planet Limited.
5.6 If your order weight exceeds 2KG and is an overseas order we will contact you to confirm the actual postage costs.

6. 10th PLANET LTD’s RIGHT TO USE FEEDBACK OR SUGGESTIONS YOU SUBMIT

6.1 10th Planet wants your voluntary feedback and suggestions on the Services we provide so that we can continually improve the services for you and other customers.
6.2 You should understand that by submitting any feedback or suggestions to 10th Planet concerning the Services we provide, you warrant and represent that you own or otherwise control the rights necessary to do so and you are granting 10th Planet permission to:

Use, modify, copy, distribute, transmit, publicly display, publicly perform, reproduce, publish, sublicense, create derivative works from, transfer, or sell any such feedback or suggestions.

7. UNDER THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS ACT WE WILL

7.1 Provide you with clear information about our products and services before you choose to purchase.
7.2 Be clear about our postage and packing costs and whether VAT or any other tax is included in the prices shown on our website upon checkout.
7.3 Provide a written confirmation of order following your purchase in the form of a confirmation email.
7.4 Allow a "cooling off" period where by you, the customer, can change your mind and cancel or return the order within 7 working days for most goods in their original packaging and unused. Certain exclusions do apply with items such as dedicated signature products.
7.5 Allow you the right to cancel your order with no loss other than return postage and packing.

8. AVAILABILITY

8.1 All products and services are subject to availability and may be withdrawn at any time, including after you have placed your order.
8.2 If your order cannot be fulfilled we will let you know as soon as possible.
8.3 We reserve the right to withdraw any item from sale at any time, including after you have placed your order, due to our suppliers not being able to fulfil our orders.

9. EMAIL

9.1 Where possible please do not use Hotmail or Yahoo email accounts as the spam filters on these programs automaticlly delete our emails.
9.2 If you have no other email account please add our email to your 'safe senders list' to ensure you recieve emails from us.
